Ed Silvester Photography

These Terms & Conditions apply to all photographic services provided by Ed Silvester (“the Photographer”) and to the purchase and licensing of images via edsilvester.com.

1. Photographic Services (Commissioned Work)

1.1 Booking & Charges

  • Photographic services are charged on a half-day basis, not by the hour.

  • A half day constitutes up to four (4) consecutive hours of shooting.

  • Any extension beyond a half day is chargeable as an additional half day.

  • Travel time is charged separately and is not included within shooting time.

  • Reasonable travel expenses may also be charged in addition, where applicable.

1.2 Post-Production

  • Post-production time is included at a reasonable level for each half day of shooting.

  • This includes image selection, colour correction, tonal adjustments, and basic retouching.

  • Extensive retouching, compositing, or additional editing requests may be quoted and charged separately.

1.3 Usage & Image Fees

  • The cost of images and usage rights is subject to negotiation and is dependent on:

    • Intended use

    • Duration of use

    • Geographic territory

    • Media format

  • No usage rights are granted unless explicitly agreed in writing.

1.4 Copyright & Ownership

  • Copyright of all images remains with the Photographer at all times.

  • No rights are transferred until payment has been made in full.

  • Until full payment is received, images may not be published, reproduced, or distributed.

1.5 Payment Terms

  • Invoices are payable within the period stated on the invoice (unless otherwise agreed).

  • Late payment may result in withdrawal of usage rights and/or additional fees.

1.6 Cancellations

  • Cancellations made within a short notice period may be chargeable in part or in full, depending on timing and incurred costs.

1.7 Model Release & Authority

  • Unless otherwise agreed in writing, the Client confirms that all necessary model releases, property releases, or permissions have been obtained for any individuals, locations, or privately owned property appearing in the commissioned photography.

  • Where individuals are commissioned, directed, or made available by the Client, a model release is assumed.

  • The Photographer accepts no responsibility for claims arising from the Client’s failure to obtain appropriate permissions or releases.

  • The Client agrees to indemnify the Photographer against any claims, damages, or legal costs resulting from the absence or invalidity of such releases.

2. Purchase of Images from the Online Gallery

2.1 Image Licensing

  • Images purchased from the gallery are licensed, not sold.

  • The licence granted is use-specific and limited to the terms agreed at the time of purchase.

2.2 Pricing

  • Image prices are based on intended usage and are agreed prior to download or delivery.

  • Fees may vary depending on commercial, editorial, or personal use.

2.3 Copyright

  • Copyright remains with Ed Silvester.

  • Purchase does not grant ownership of the image or copyright.

2.4 Payment & Delivery

  • Images will only be made available once payment has been received in full.

  • Any unauthorised use prior to payment constitutes a breach of these terms.

2.5 Prohibited Use

  • Images may not be altered, resold, sublicensed, or used outside the agreed licence without prior written consent.

3. General

3.1 Liability

  • The Photographer will take reasonable care in the performance of services but shall not be liable for circumstances beyond reasonable control.

3.2 Governing Law

  • These Terms & Conditions are governed by the laws of England and Wales.

3.3 Acceptance

  • Booking photographic services or purchasing images constitutes acceptance of these Terms & Conditions.
